Kajian Hukum Normatif mengenai Pertanggungjawaban Lembaga Manajemen Kolektif terhadap Hak Cipta Pencipta Lagu di Indonesia: Kasus Ari Lasso dan WAMI

The background of this research is based on the increasing number of disputes related to the management of music royalties in Indonesia, which shows the weak legal protection system for copyright and the lack of optimal accountability of LMK in carrying out its functions. This study aims to examine normatively the accountability of collective management institutions for the copyright of song creators, especially in the context of the cases of Ari Lasso and WAMI, as well as the efforts that can be made to strengthen the accountability mechanism of Collective Management Institutions in ensuring the protection of the economic rights of song creators. The type of research applied in this study is normative research. Normative research is research that focuses on norms, legal principles, and provisions of laws and regulations, with the main data source in the form of literature materials. The data source is obtained from primary legal materials such as Law Number 28 of 2014 concerning Copyright, its implementing regulations, as well as secondary legal materials in the form of literature, journals, and official documents relevant to the problem being studied. The analysis was carried out qualitatively with an emphasis on the application of legal norms to copyright management practices by LMK in Indonesia. The results of the study show that normatively, LMK has a legal responsibility to manage, collect, and distribute royalties transparently and proportionately to creators in accordance with the provisions of Articles 87-95 of Law Number 28 of 2014 concerning Copyright. However, in practice, there are still inconsistencies between legal principles and their implementation, such as in the case of Ari Lasso and WAMI which show a lack of information disclosure and an unaccountable royalty distribution mechanism. This condition emphasizes the need to strengthen the regulatory and supervisory system for LMK in order to carry out its functions effectively, transparently, and in accordance with the principle of justice for creators.
